Terms of Service – Foldmark
1. Acceptance of Terms
By installing, accessing, or using the Foldmark Chrome extension (the “Service”), you agree to these Terms of Service. If you do not agree to these Terms, do not use the Service.
2. Description of the Service
Foldmark is a local-first Chrome extension that allows users to save highlighted text from webpages, organize bookmarks into folders and workflow states, search, revisit, edit, and export saved content, and optionally use AI-assisted features.
3. Eligibility and Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with applicable laws and regulations.
You must not use Foldmark to:
- store, transmit, or organize unlawful content
- violate the rights of others
- attempt to misuse, disrupt, or reverse engineer the Service beyond what applicable law permits
- use third-party AI or export features in a way that violates third-party terms
You remain responsible for the content you choose to save, export, or send to optional AI providers.
4. Data and Privacy
Foldmark is local-first.
- Your saved bookmarks, notes, folders, and preferences are stored locally by default.
- Optional analytics are anonymized and opt-in only.
- You retain ownership and control of your local data.

5. Analytics Retention and Upload Behavior
- Anonymous analytics upload is disabled by default.
- If enabled by you, events are batched and uploaded periodically rather than on every single action.
- Failed uploads may be retried automatically using exponential backoff.
- Remote analytics events may be retained for up to 90 days.
6. AI Features
If you enable and use AI features, selected content and related metadata may be sent to a third-party AI provider. You are responsible for deciding what content you choose to send, and the third-party provider’s terms, privacy practices, and policies apply to those requests.
Foldmark does not control third-party AI providers and is not responsible for their availability, outputs, or handling of submitted content.
7. Exports and Third-Party Content
The Service may allow you to export content as TXT, PDF, or other supported formats. You are responsible for ensuring that your use, storage, and export of saved content complies with applicable laws, contractual obligations, and any rights held by third parties.
8. No Warranty
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by law.
We do not guarantee that the Service will be uninterrupted, error-free, secure in every circumstance, or that saved data will never be lost or corrupted.
9. Limitation of Liability
To the maximum extent permitted by law, Foldmark and its operators will not be liable for data loss, indirect or consequential damages, losses arising from use of or inability to use the Service, or issues caused by third-party services, including AI providers or hosting providers.
10. Changes to the Service or Terms
We may update, modify, suspend, or discontinue parts of the Service at any time. We may also update these Terms from time to time. Continued use of the Service after updated Terms are made available constitutes acceptance of the updated Terms.
11. Termination
You may stop using the Service at any time. We may limit or discontinue access to the Service if necessary to protect the product, comply with legal obligations, or enforce these Terms.
12. Governing Law
These Terms are governed by the applicable laws of your jurisdiction, without prejudice to any mandatory consumer protection rights that may apply where you live.
